IMPORTANT: These Terms govern your use of GenieOptimize, an AI-powered LLM optimization platform. By using our Services, you agree to these legally binding terms, including provisions on AI usage, data processing (GDPR/CCPA compliant), arbitration, and liability limitations.
By accessing GenieOptimize ("Services"), you agree to these Terms of Service ("Terms"), our Privacy Policy, and Cookie Policy. If you disagree, do not use the Services.
You must be 18+ years old or the age of majority in your jurisdiction. For business accounts, you represent authority to bind your organization to these Terms.
GenieOptimize provides:
You must provide accurate information and maintain account security. You're responsible for all activities under your account. Multi-account creation to circumvent limits is prohibited.
We target 99.9% uptime monthly but do not guarantee uninterrupted access. Beta features are provided "as-is" and may change without notice.
Current pricing and full feature details available at genieoptimize.com. Plans may be changed with 30-day notice.
All payments via Stripe. Subscriptions auto-renew unless canceled. Price changes effective next billing period with 30-day notice. Failed payments may result in suspension.
New accounts receive a 7-day free trial with Growth-level access (up to 3 domains, all features). One trial per account. No payment information is required to start a trial. When the trial expires, access to all features is suspended until you subscribe to a paid plan. Your domains, analysis data, and optimization history are preserved for 90 days after trial expiration.
If you subscribe to a plan with a lower domain limit than the number of domains you created during your trial or a previous plan, excess domains will be archived. You will have a 7-day grace period to choose which domains to keep active. After the grace period, the least-recently-updated domains will be automatically archived. Archived domains stop receiving optimization updates and SDK serving, but their data is preserved. You can reactivate archived domains by upgrading to a plan with a higher domain limit.
Cancel anytime via dashboard or support. Effective end of current billing period. No pro-rata refunds. Upon cancellation, your account will transition to an expired state. All domains and analysis data are preserved for 90 days. SDK optimization serving stops immediately upon expiration. You may resubscribe at any time to restore access.
Fees exclude taxes (VAT, GST, sales tax). You're responsible for applicable taxes. We collect/remit where legally required.
Use Services for lawful purposes: optimizing legitimate websites, analyzing owned content, integrating SDK on authorized sites.
You may NOT:
Cannot optimize sites containing: illegal content, hate speech, extreme violence, counterfeit goods, unverified medical claims, human trafficking, child exploitation.
Usage subject to plan-based quotas. Excessive use may result in throttling or suspension.
We reserve right to warn, suspend, terminate accounts, remove content, or report violations to authorities.
Services (software, AI models, designs, trademarks) owned by or licensed to GenieOptimize. Protected by copyright, trademark, patent laws.
Limited, non-exclusive, revocable license to access Services, use SDK on owned sites, and use generated optimization rules.
Cannot copy, modify, sell, resell, or reverse engineer Services. Cannot remove proprietary notices or develop competing products.
You retain ownership of submitted content. Grant us limited license to process, analyze, generate optimizations, and use aggregated anonymous data.
We do NOT use your content to train third-party AI models without consent. Content processed by third-party APIs (Claude, GPT) subject to their policies.
Feedback/suggestions grant us perpetual, royalty-free license to use without compensation.
ChatGPT, Claude, Gemini, and Perplexity are trademarks of their respective owners. GenieOptimize is an independent tool and is not affiliated with, endorsed by, or sponsored by these companies.

We maintain records of:
Human review available for quality assurance, policy violations, escalations, and system monitoring.
Contest automated decisions. Report issues to support. Human review upon request for significant concerns.
We may update AI models anytime. Notification of material functionality changes.
Paid subscribers receive API access with rate limits per plan. Requires API key authentication. Activity under your keys is your responsibility.

Install only on domains you own/control. Cannot modify, reverse engineer, or redistribute. Update for security patches.
Backwards compatibility maintained 6+ months after deprecation. Migration guides provided for breaking changes.
Data collection governed by Privacy Policy. Please review carefully.
Your Rights:

California Resident Rights:
Data may transfer to US/other countries. Safeguards include Standard Contractual Clauses (SCCs) for EU transfers and adequacy decisions.
Business customers: DPA with SCCs available on request for GDPR compliance.
Affected users/authorities notified within 72 hours of breach discovery (as required by law).
Services not for under-18 (under-16 in EU). No knowing collection from children. Prompt deletion if discovered.
Retained while account active. Deleted/anonymized within 90 days of account closure (except legal requirements).
SERVICES PROVIDED "AS IS" WITHOUT WARRANTIES:
TO MAXIMUM EXTENT PERMITTED BY LAW:
Exceptions: Gross negligence, willful misconduct, personal injury/death, IP violations (where law prohibits exclusion).
You indemnify us for claims from:
We indemnify you for: Valid IP infringement claims (copyright/trademark/patent) from Services use (with conditions).
Cancel anytime via dashboard or support. Immediate or end-of-period effective.
We may suspend/terminate for: Terms violations, non-payment, fraud, illegal activity, security threats, prolonged inactivity.
Upon termination: Service access ceases, SDK optimization serving stops, data deleted/anonymized after 90-day retention period (except legal retention requirements). Voluntary cancellation preserves your data for 90 days to allow resubscription.
Sections survive: IP Rights, Warranties, Liability, Indemnification, Disputes, General Provisions.
First contact privacy@genieoptimize.com for 30-day good-faith resolution attempt.
Disputes via AAA arbitration. Exceptions: injunctive relief, IP disputes, small claims (<$10K).
Business users: Individual disputes only. No class actions/arbitrations (where law permits).
EU consumers: EC ODR Platform
Claims must be brought within 1 year (except longer legal requirements).
We may update Terms anytime. Material changes: 30-day notice via email/dashboard. Continued use = acceptance.
Terms + Privacy + Cookies = complete agreement. Supersedes prior agreements.
Invalid provisions limited/eliminated minimally. Remaining provisions remain valid.
We may assign freely (merger/acquisition/asset sale). You cannot assign without written consent.
No liability for failures beyond reasonable control: acts of God, disasters, war, strikes, internet failures.
Comply with US EAR, OFAC sanctions, EU export regulations. No export to prohibited countries/entities.
Services target WCAG 2.1 Level AA, ADA, Section 508, European Accessibility Act compliance.
